{"id":6379,"date":"2021-08-15T23:10:10","date_gmt":"2021-08-15T23:10:10","guid":{"rendered":"https:\/\/www.sygna.io\/?p=6379"},"modified":"2021-08-15T23:43:08","modified_gmt":"2021-08-15T23:43:08","slug":"uk-crypto-travel-rule-implementation-starts-with-public-consultation","status":"publish","type":"post","link":"https:\/\/www.sygna.io\/jp\/blog\/uk-crypto-travel-rule-implementation-starts-with-public-consultation\/","title":{"rendered":"UK Crypto Travel Rule Implementation Starts With Public Consultation"},"content":{"rendered":"\n<p>Last month the UK government\u2019s finance ministry HM Treasury <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1004603\/210720_SI_Consultation_Document_final.pdf\">finally announced<\/a> that it will be <a href=\"https:\/\/www.coindesk.com\/uk-starts-consultation-on-applying-travel-rule-to-crypto\">holding a long-anticipated public consultation<\/a> to discuss, among other subjects, its planned implementation of FATF\u2019s Travel Rule for cryptocurrency transactions. This comes soon after the <a href=\"https:\/\/www.sygna.io\/blog\/eu-aml-cft-law-crypto-wallet-regulation\/\">European Commission recently announced its own expansive AML draft<\/a> to adopt the Travel Rule into EU-wide legislation among other things.<\/p>\n\n\n\n<p>The public consultation was launched on 22 July and will run until 22 October 2021 (which should synchronize it well with the <a href=\"https:\/\/www.sygna.io\/blog\/fatf-plenary-second-12-month-review-of-virtual-assets-vasp\/\">FATF\u2019s expected new guidance<\/a> due for November 2021), with legislation expected to be introduced in spring 2022.&nbsp;<\/p>\n\n\n\n<p>The consultation \u201cinvites the views from industry, law enforcement, supervisors, and the broader public and civil society\u201d on potential amendments to Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (MLRs).<\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Implementing the Travel Rule Into UK Legislation\u00a0<\/h2>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img decoding=\"async\" width=\"696\" height=\"415\" src=\"https:\/\/www.sygna.io\/wp-content\/uploads\/2020\/06\/fca-uk-crypto-regulation.jpg\" alt=\"\" class=\"wp-image-4781\" srcset=\"https:\/\/www.sygna.io\/wp-content\/uploads\/2020\/06\/fca-uk-crypto-regulation.jpg 696w, https:\/\/www.sygna.io\/wp-content\/uploads\/2020\/06\/fca-uk-crypto-regulation-600x358.jpg 600w\" sizes=\"(max-width: 696px) 100vw, 696px\" \/><\/figure><\/div>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Part of the UK government\u2019s plan to amend the MLRs includes transposing the Financial Action Task Force (FATF)\u2019s Travel Rule update, which debuted in the summer of 2019, and have been subject to two 12-month reviews since, into domestic legislation. The regulations require that the originator and recipient of all cryptocurrency transactions be \u201ctransmitted and received alongside the transfer, in an appropriate format\u201d.<\/p>\n\n\n\n<p>The report includes several of FATF\u2019s proposals, including the suggestion that there should be a \u00a31000 withdrawal limit for beneficiaries if any required information is missing. However, it is the responsibility of crypto firms to determine the value of the \u00a31000 threshold in a cryptocurrency transfer.<\/p>\n\n\n\n<p>On July 22, HM Treasury announced that the public consultation represents a critical step toward amending UK AML\/TF regulations.<\/p>\n\n\n\n<p>&#8220;The government has been kept informed of technological developments, such as the development of common data standards and the progress of a large number of software solutions, and considers that the time is now right to begin planning for the implementation of the travel rule.\u201d<\/p>\n\n\n\n<p>HM Treasury stated that the Travel Rule should be applied consistently across all financial industries, \u201cregardless of the technology being used to facilitate transfers, unless there is a compelling reason to adopt a different approach\u201d. It also stated that existing Anti-Money Laundering and Combating the Financing of Terrorism (AML\/CFT) regulations don\u2019t transfer smoothly to cryptocurrency because of the peculiarities of the sector, and therefore need to be adapted.<\/p>\n\n\n\n<p>The regulations will apply to all crypto asset service providers (CASPs) such as crypto-asset exchange providers and custodian wallet providers that conduct business within the UK.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>&#8220;The government\u2019s approach to implementation is guided by the principle that the application of [the travel rule] should be consistent across the financial services industry, regardless of the technology being used to facilitate transfers, unless there is a compelling reason to adopt a different approach. The requirements will apply to cryptoasset exchange providers and custodian wallet providers, as defined in The Money Laundering and Terrorist Financing (Amendment) Regulations 2019, which are carrying on business in the UK.&#8221;<\/em><\/p><\/blockquote>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Treasury delayed Travel Rule adoption to encourage technological solutions<\/h2>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>HM Treasury stated that it has delayed formal adoption of FATF\u2019s travel rule so as to allow crypto firms a chance to develop compliance solutions.&nbsp;<\/p>\n\n\n\n<p>In the consultation report, it stated that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u201cThe government has been kept informed of technological developments, such as the development of common data standards and the progress of a large number of software solutions, and considers that the time is now right to begin planning for the implementation of the travel rule\u201d.<\/em><\/p><\/blockquote>\n\n\n\n<p>The <a href=\"https:\/\/www.sygna.io\/blog\/financial-conduct-authority-fca-crypto-asset-registration-and-regulation-in-uk\/\">Financial Conduct Authority (FCA)<\/a>, which is the primary UK regulator for crypto firms, has been compiling a list of licensed firms, of which only five of have been approved so far under this new framework.\u00a0It recently extended the <a href=\"https:\/\/www.sygna.io\/blog\/fca-crypto-company-aml-registration-deadline\/\">AML registration period to March 2022<\/a> after over 90% of firms assessed to date withdrew their applications.<\/p>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Covid-19 May Delay Implementation<\/h2>\n\n\n\n<div style=\"height:35px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>The social distancing measures of the Covid-19 pandemic are expected to slow down the process of implementing the Travel Rule into UK legislation.
